However, this data is not considered personal data under the law as it does not directly or indirectly reveal your identity. 4. HOW WE USE YOUR PERSONAL INFORMATION

We use your personal data only when the law allows us to do so. We usually use your personal data in the following circumstances:

  • When we need to perform the agreement we have or want to make with you;
  • when deemed necessary for our legitimate interests or those of a third party, and your interests, together with your fundamental rights, do not override these;
  • When we are able to comply with a legal or regulatory obligation.

Below are all the ways we plan to use your personal data:

  • registration as a new customer;
  • Process and deliver your order(s);
  • Manage our relationship with you (for example, by asking you to review your purchase);
  • participation in a contest or survey;
  • Display relevant website content and advertisements;
  • Send e-mail communications if you have given your express consent;
  • Use of data analysis to improve the website, products, marketing and user experience;

With your consent, we may use your personal data to send you information about products, offers, promotions and events we think you may be interested in. If you have chosen to opt out, you will no longer receive this information from us. However, you will continue to receive transactional emails from us regarding an order you have placed with us, such as order confirmation, shipping confirmation, product review, return/refund confirmation, and when an item has come back into stock if you have requested notification to do so.

We use your technical and usage data to further improve our website to provide you with a better shopping experience. This is necessary for our legitimate interests and allows us to study how customers interact with the website, products and services, which in turn contributes to the development and growth of our business and marketing strategy.

Third Party

We may share your personal data with the following categories of third parties:

  • Payment system providers that process your payments for products.
  • Delivery companies we use to deliver or pick up your orders to you.
  • With your permission agencies and vendors we have engaged to help us conduct promotional and marketing activities and to provide technical assistance and support.

We will also disclose your personal data to third parties:

  • If we are legally required to disclose or share your personal data to comply with a legal obligation or a lawful request from a legal or regulatory authority; or
  • to respond to claims and to establish, exercise or defend our legal rights.

Most third parties with whom we share your personal data are limited (by law and contract) in their ability to use your personal data for the specific purposes specified by us. These third parties are themselves subject to the General Data Protection Regulation (GDPR). They are responsible for their own processing of personal data to the extent such processing is subject to, or related to, that Regulation.

We always ensure that all third parties with whom we share your personal data are subject to privacy and security obligations consistent with this Privacy Notice and applicable law.

We will ensure that we obtain your explicit consent before sharing your personal data with external third parties that we use for email marketing purposes. We do not control these third-party websites, nor are we responsible for their own privacy or cookie policies. When you decide to leave our website, we encourage you to read in full the privacy and cookie policies of each website you decide to visit.

Unsubscribe

At any time, you have the right to request that we or third parties stop sending you marketing messages. You can do this by opening an e-mail you have received from us and clicking “unsubscribe” at the bottom of the e-mail. You can also send us an email requesting that we remove your email address from our database. This may take up to 2 business days.

If you choose to opt out of marketing communications from us, you will continue to receive emails about your orders placed with us. This includes emails such as order confirmation, shipping confirmation, product/service experience (e.g. product review), emails about abandoned shopping carts and information related to returns, such as exchange or refund confirmations. This is a legitimate interest for both our company and our customers.

Should we wish to use your personal data for a different purpose, we will update this privacy policy and notify you.

5. LEGITIMATE INTEREST

According to the AVG legislation, we may contact you if we believe that you have shown a legitimate interest in our company and products. For example, if a customer has purchased a product from us, has shown interest in the products and brands, or has a professional interest in the products and brands we sell, we may therefore contact them because we know they have shown a legitimate interest in our company/our services.

When you first visit our website, you will be given the opportunity to select your cookie preferences. You can choose to accept all cookies, including performance and marketing cookies, or you can accept only the cookies that are strictly necessary for the website to function properly. We use performance and marketing data to ensure that we display relevant information to you and to provide a better shopping experience. It is our legitimate interest to use and analyze this data for our growth and future development. You have the right to update your cookie preferences at any time.

Where appropriate, we may implement an automated abandoned shopping cart email program that contacts you via email if you decide to abandon your shopping cart without making a purchase. We consider this email valid and acceptable because of the legitimate interest a customer has shown in us. This email is sent shortly after they leave their cart and contains only information related to the product(s) left in the cart. The customer’s email address is not stored in our subscription list and they cannot be contacted for other marketing purposes unless they have given us explicit permission to do so. The customer has the right to unsubscribe from emails about abandoned shopping carts at any time and will not be contacted in the future, unless they have given us explicit permission or have placed an order with us and are receiving transactional emails as previously mentioned.

6. YOUR LEGAL RIGHTS

According to the General Data Protection Regulation (GDPR), which is designed to protect your personal data, every time we use, share or otherwise process your personal data, we need what is called a legal basis or foundation. When you use our site to purchase products from us, processing your personal data is necessary to fulfill your orders and is a legal basis for collecting and using the data you provide to us.

Certain uses of your personal data or other processing activities may not be strictly necessary to carry out our legal duties or exercise our powers; however, they may be necessary for the purposes of our legitimate interests or the legitimate interests of a third party. It may also be in your best interests.

By “legitimate interests,” we mean our (or a third party’s) interests in operating the service as efficiently and securely as possible. For example, we may choose to store your personal data with a third party; we may do so because our use of that service means that your personal data is more secure.

To take full advantage of our site, such as to take advantage of offers, promotions or receive marketing messages, we need your consent to collect and use your personal data. In these circumstances, we will inform you about how the data you provide will be collected, stored and used before we seek your consent. In addition, you will be informed about how you can withdraw or change your consent at any time.

You may withdraw your consent or object to our processing of your personal data in a particular way (if you have the right to do so) by contacting us (www.analemma-water.nl/contact).

What are your rights regarding your personal data?

You have certain rights with respect to your personal data. These rights do not apply in all cases or to all personal data processed by us.

For example, certain rights do not apply when we need to process your personal data to meet our legal obligations.

You have the right to require us to:

  • we provide you with a copy of all personal data we hold about you;
  • we update your outdated or inaccurate personal data;
  • we delete any personal data we hold about you (although in these circumstances it may be difficult to provide you with orders you need);
  • we limit the way we process your personal data;
  • we take into account valid objections you have to our use of your personal data; or
  • we provide your personal data to an outside service provider.

We will consider all such requests (including whether they are applicable in a specific case) and provide our response within the statutory period of 30 days (1 month from receipt).

When you make a request, we will confirm your request and may ask you to provide us with further information so that we can verify your identity.

Changes to our privacy policy

We may change this privacy policy from time to time. Future changes to our privacy policy will be notified to you in the next communication from us to you, such as a new order or newsletter you have consented to receive. The date of our most recent changes is listed at the bottom of this policy and is updated with each update. The most recent and updated policy is available on our website at all times, unless the website is undergoing scheduled maintenance.
